8.
The driver has the right to:
-
8.1.
drive the vehicle under the established procedure;
-
8.2.
know the reason why a SAI official, other officials mentioned in sub-clause 9.1 of clause 9 of these Rules, has stopped the vehicle, and also be given the surnames and positions of these officials. In this instance, officials having the right to check the driver's documents are obliged to present, on driver's request, the official identification;

8.3.
transfer control over the vehicle to another person having on him a driving permit to drive a power-driven vehicle of the respective category, with a coupon thereto (certificate of a tractor driver of the respective category with a coupon thereto, temporary permission to drive a power-driven vehicle) (unless otherwise provided, hereinafter — driving permit).

9.
The driver is obliged to:

9.1.
stop on demand of a SAI official wearing a uniform, and also officials mentioned in part three of this sub-clause.
A demand of a SAI official to stop the vehicle must be carried out promptly, be obvious to the driver, and be expressed via a signal with the traffic baton, arm sign, loudspeaker tool, or via turning on of red beacon lights on the operative-service vehicle.
Officials of the Investigative Committee, bodies of internal affairs (except for SAI officials), state protection bodies, State Inspectorate on wildlife protection under the President of the Republic of Belarus, financial investigation bodies of the State Control Committee, Armed Forces of the Republic of Belarus, interior troops of the Ministry of Internal Affairs, state security bodies, border service bodies, customs bodies, Transport Inspection of the Ministry of Transport and Communications have the right to stop vehicles only for carrying out functions imposed on mentioned bodies. In this instance, they must wear a uniform (except for officials of the Transport Inspection of the Ministry of Transport and Communications), high visibility vest with elements of retroreflecting material, and use a red signal disk (retroreflector) for making signals.
At night-time outside built-up area, beside indicated officials there must be an operative-service vehicle with switched-on beacon lights.

9.2.
upon demand of the SAI official, pass, under the established procedure, the inspection (examination) on alcoholic intoxication or other state caused by consumption of narcotic substances, psychotropic and analogous substances, toxic or other intoxicating substances;

9.3.
maintain the vehicle participating in road traffic, in a technically sound condition, check its technical condition before the beginning of movement, and also maintain clean its windows and outer light equipment;

9.4.
timely submit a power-driven vehicle participating in road traffic and being in his possession and also its trailer for the state technical inspection;
-
9.5.
keep the belts fastened and do not carry passengers with unfastened safety belts during the movement in a power-driven vehicle equipped with safety belts, and while driving a motorcycle, moped — wear a clasped crash helmet and do not carry passengers without clasped crash helmets. A person being trained to drive a power-driven vehicle must also keep the safety belts fastened.
It is allowed not to fasten the safety belts for:
— a person training to drive a power-driven vehicle, when the vehicle is driven by the person being trained to drive;
— a passenger of an operative-service vehicle, a taxi driver — while driving in a built-up area;
— a passenger and a driver with medical contraindications the list of which is determined by the Ministry of Health;

9.6.
perform no actions that distract him from driving the vehicle;

9.7.
ensure safe conditions for the carriage of passengers;
-
9.8.
enter a road and exit the road, cross a dividing strip, dividing zone in the places specified for such actions (places marked with respective road signs, road marking, equipped with protecting or directing tools, etc.);

9.9.
take measures on slowing down, including stopping of the vehicle, ensuring safe conditions for the road traffic of pedestrians (including children, disabled persons, elderly people, and also cyclists, being on the road), give way to pedestrians on non-regulated and regulated pedestrian crossings when the signal of the authorized official directing traffic or the traffic lights is authorizing simultaneously drivers and pedestrians to proceed;

9.10.
leave driver's seat or leave the vehicle only in case if measures excluding spontaneous movement of the vehicle were taken;

9.11.
when transferring the control over a power-driven vehicle to another person, make sure that such a person has the driving permit on him (except for the instance of training to drive a power-driven vehicle);

9.12.
give the vehicle for clearing the carriageway from vehicles damaged in a road accident and also deliver on the driven vehicle*:
— persons in need of urgent medical treatment to the closest healthcare organization, upon a request of officials of law enforcement bodies and healthcare organizations;
— workers of healthcare organizations for the travel to a location of a patient whose life is in danger;
— workers of law enforcement bodies for performance of urgent official duties connected with persecution of persons suspected of committing crimes, when the mentioned workers take necessary measures to ensure safety of the driver and passengers of the vehicle;
* This requirement does not cover vehicles of diplomatic missions, consular institutions, international organizations and foreign citizens, who enjoy diplomatic immunity in accordance with treaties of the Republic of Belarus.
The person who used the vehicle must, on a driver's request, issue a relevant reference or make a notice in the route sheet specifying the duration of the trip, distance passed, his surname, position, number of the official identification, name of the respective organization. On the request of the owner of the vehicle, all expenses connected with the use of the vehicle, shall be reimbursed under the procedure established by the legislation;

9.13.
train to drive a power-driven vehicle in an individual manner just on pads or autodroms, closed for road traffic, if he the driving permit on him and driving experience of not less than two years.

10.
The driver is prohibited to:
-
10.1.
drive a vehicle in the state of alcoholic intoxication or in the state caused by consumption of narcotic substances, psychotropic and analogous substances, toxic or other intoxicating substances and also to consume alcoholic or low-alcoholic beverages, beer, narcotic substances, psychotropic and analogous substances, toxic or other intoxicating substances after the demand of an official of internal affairs bodies to stop the vehicle until the inspection (examination) on alcoholic intoxication or the state caused by consumption of narcotic substances, psychotropic and analogous substances, toxic or other intoxicating substances is passed under the established procedure. In these instances SAI officials are entitled to make the detention and forced towing of the vehicle in case no other legal possibility is available to deliver the vehicle to a place of storage;

10.2.
drive the vehicle in a diseased or tired state that endangers safety of the road traffic, or under the influence of medicines decreasing attention and reaction time;

10.3.
participate in road traffic on a vehicle covered with dirt (laminations), limiting the driver's field of vision and also making indiscernible the information on the registration plate at a distance of 40 meters and less;
-
10.4.
make use of a radio- or telephone communication device unequipped with a technical tool permitting to hold talks hands free during the movement of the vehicle;
-
10.5.
drive on a heavy and/or bulky vehicle without a special permission issued under the procedure established by the legislation, or with violation of conditions determined in such permission, and deviate from the route indicated in this permission;

10.6.
move on a crawler-type vehicle or vehicle with metallic studs (except studded tires) on the road of a common use with improved surface.

11.
The owner of the vehicle or a person who has the right to drive the vehicle is prohibited to transfer the control over the such vehicle to another person:
-
11.1.
who has the driving permit on him;
-
11.2.
without having proved that the person to whom the control is transferred is not in the state of alcohol intoxication or other state caused by consumption of narcotic substances, psychotropic and analogous substances, toxic or other intoxicating substances.

12.
The driver of a power-driven vehicle is obliged to have on him and submit for the inspection:
-
12.1.
to SAI officials:
-
12.1.1.
driving permit;
-
12.1.2.
certificate on registration (technical passport, technical coupon) of a power-driven vehicle, its trailer (trailers) or passport of the vehicle (its chassis) manufactured in the Republic of Belarus and being delivered to a consumer or to the place of state registration in self-propelled mode (hereinafter — passport of a vehicle (chassis of the vehicle);

12.1.3.
document (certificate) on passing the state technical inspection (with the exception of vehicles not registered earlier in the Republic of Belarus and being delivered to a consumer or to the place of state registration in self-propelled mode);

12.1.4.
document confirming the conclusion of a contract on obligatory insurance of civil liability of the vehicle's owner (contract of borderline insurance or insurance contract “Green card”, valid in the territory of the Republic of Belarus);
-
12.1.5.
permission from the communication body to use radio- and satellite communication equipment, if available in the vehicle in the instances provided by the legislation (except for the driver of the operative-service vehicle);
-
12.2.
to officials mentioned in part three of sub-clause 9.1 of clause 9 of these Rules, — a document proving his identity or the driving permit.

13.
Drivers of power-driven vehicles belonging to legal persons and individual entrepreneurs carrying out activities in the sphere of automotive transport, are also obliged to have on them and hand over for the inspection to SAI officials or officials of Transport Inspection of the Ministry of Transport and Communications transport and other documents, provided by legislative acts.
Other officials have the right to inspect the documents of drivers of power-driven vehicles only in the instances provided by the legislative acts, in order to carry out the functions imposed on respective state bodies.

14.
Foreign citizens and stateless persons, temporally staying or temporally residing in the Republic of Belarus, when driving a power-driven vehicle, must have:

14.1.
documents mentioned in sub-clauses 12.1.4 and 12.1.5 of clause 12 of these Rules;
-
14.2.
national driving permit that complies with the requirements of the Convention on Road Traffic signed at Vienna on 8 November 1968 (hereinafter — the Convention), and in the event of incompliance with the requirements of the Convention — national driving permit with notarized translation to one of the state languages of the Republic of Belarus;
-
14.3.
certificate on registration of the vehicle, complying with the requirements of the Convention, — in the event of driving a vehicle not registered in the Republic of Belarus and temporally located in its territory;
-
14.4.
a vehicle must have registration plates issued by a competent body of the state in which it is registered.

15.
The driver of a power-driven vehicle equipped with a tachograph is obliged, upon a demand of SAI officials or officials of the Transport Inspection of the Ministry of Transport and Communications, to present:

15.1.
in the event of an analogue tachograph — paper charts (tachograms);
-
15.2.
in the event of a digital tachograph — driver card, print-outs from the tachograph, registration cards (tachograms), provide access to the tachograph;
-
15.3.
certificate on inspection (calibration) of the tachograph.
